EU Council Agrees on Position to Streamline Cross-Border GDPR Enforcement

On 13 June 2024, the Council of the European Union reached a common position aimed at improving cooperation among national data protection authorities for enforcing the GDPR in cross-border cases. The objective of this law is to harmonize procedures, speed up complaint handling, and reduce inconsistencies across Member States.

The draft regulation strengthens the operational framework by clarifying key procedural elements. It introduces uniform admissibility criteria for cross-border complaints, defined timelines for investigation phases and EDPB opinions, and mechanisms for early resolution in straightforward cases. It also ensures that both complainants and controllers under investigation have the right to be heard at appropriate stages.

This development brings the GDPR enforcement mechanism closer to its intended efficiency by reinforcing the one-stop-shop principle with clearer and faster processes.
